Success Highlight: EB-2 NIW Approval for Financial Engineer from China
On May 23, 2023, LPY Law Group received approval of an EB-2 National Interest Waiver (NIW) I-140 immigrant petition for a financial engineer from China. The United States Citizenship and Immigration Services (USCIS) approved the petition without Request For Evidence.
For EB-2 I-140 immigrant petitions, the petitioner must show that she is either an advanced degree professional or possesses exceptional ability in the sciences, arts, or business. For most EB-2 I-140 petitions, she must also have a permanent US job offer and an approved labor certification. However, the NIW waives the requirements of a permanent US job offer and an approved labor certification if the petitioner can show that her entry into the US as a permanent resident is in the national interest.
Our client had master’s degrees in finance from foreign and US universities and was employed in the private sector at a major financial institution. Her case was unique in that Client did not have any published works, citations, or patents. Instead, evidence of her achievements and significant contributions to financial engineering consisted of a series of media reports that cited Client’s work or interviewed her directly. To demonstrate the recognition of her achievements and contributions, LPY Law Group submitted testimony from leading experts in Client’s field, proof of the wide circulation and impact of the media articles, and evidence on the national importance of client’s work for the financial sector and economy of the United States.
Based on the substantive evidence, we were able to successfully argue that our client would serve the national interest by minimizing financial risk and advancing strategic financial knowledge for major financial institutions, thereby promoting growth in the national economy. Even without evidence of publications or cited works, USCIS was convinced that client met the requirements for NIW and acknowledged her achievements and expertise by approving her petition.
